Apricot Capital DIFC Limited provides custody service for Professional Clients and Market Counterparties, ensuring secure and reliable safekeeping of the clients’ investments.

Safekeeping of assets

Client investments are maintained in segregated accounts* with reputable custodians** who meet the requirements of the DFSA regime.

* Upon client request, account can be maintained in a segregated account. Apricot Capital DIFC Ltd. also maintains omnibus client accounts in accordance with COB 6.11 and 6.12.

** The Client understands and accepts that Apricot Capital DIFC is not licensed to take deposits and does not hold Client Money directly; all the Client Money controlled by Apricot Capital DIFC is held in a segregated account with an External Custody Provider in the name of Apricot Capital DIFC, acting as an agent of the Client.

The Client understands and accepts that Apricot Capital DIFC is licensed to hold Client Investments directly, and may in its discretion appoint and remove External Custody Providers, in the UAE or in other jurisdictions, to perform any part of the Services in relation to Client Investments.

The Client understands and accepts that the Client Assets may be held with an External Custody Provider in the same group as Apricot Capital DIFC, where it meets the suitability requirements for any External Custody Provider, as outlined in Clause 4.7 below.

Apricot Capital DIFC shall ensure on reasonable grounds that each External Custody Provider is suitable to hold Client Assets and provide protections equivalent to those available in the DIFC, pursuant to the suitability requirements in the General Business Terms, and in accordance with Rules A5.6 and A6.5 of the COB module in the DFSA rulebook.

The Client understands and accepts that the Client Assets may be held in a jurisdiction outside the DIFC, where the market practices, insolvency and legal regimes applicable in that jurisdiction may differ from those in the DIFC, with potential consequences for the Client that may be outside of the Custodian’s knowledge or control.
